TERMS OF SALE AND INTERNATIONAL GUARANTEE

The contents of this document form part of our Terms of Service (”Terms”).

OUR TERMS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS.

Ordering process

Our web-shop will guide you through the necessary ordering steps including notifying you about additional charges or conditions, if and/or when applicable.

You will, during the payment process, be asked to tick a box to confirm that you have read and understood our Terms. Without ticking this box, you cannot purchase any goods from us.

By placing an order in our web shop, you are offering to purchase a product on and subject to our Terms. However, a contract for the purchase of goods from us will not be formed until your payment has been approved by us.

Fraud

All attempts at fraud will be reported to the police and/or other appropriate authorities and we reserve the right to cancel a purchase if any suspicion is raised.

Confirmation of purchase - Proof of purchase

An e-mail order confirmation (your Proof of Purchase - to be saved) will be sent to your e-mail address immediately after your purchase. This confirmation also serves as your Certificate of Guarantee. (“see INTERNATIONAL GUARANTEE”).

If your payment for any reason is not approved by us, we may cancel your order and you will subsequently receive an e-mail cancellation of your order. We will not be held liable for any inconvenience to you should we cancel your order.

If, due to typographical or other errors, inaccuracies, or omissions on our website, you have placed an order at an incorrect price your order will not be accepted by us. We shall inform you as soon as possible about this and give you the option to reconfirm your order at the correct price or cancelling it. If you decide to cancel your order, your payment will be refunded immediately in full.

Confirmation of shipment and tracking

When your payment has been approved by us and your order has been dispatched you will receive an e-mail shipping confirmation from us, including a UPS tracking number, notifying you that your purchase is on the way to you (see “SHIPPING, DELIVERY AND RETURNS”.

Payments

You pay for your purchase through our secure checkout by pressing the CHECK OUT button and then proceed by following our instructions.

You confirm that you undertake to provide us with true and accurate details when placing an order with us. Furthermore you confirm that you are the valid holder and owner of any credit or debit card used, or have the permission from the owner to use the card, when purchasing our products and that there are sufficient funds to cover the cost of the goods. See Terms; “ACCURACY OF BILLING AND ACCOUNT INFORMATION”.

You will not be charged for your purchase until you successfully complete your transaction as guided on our check-out page. Up till that point you have the option to opt out of your purchase.

Right to cancel

You have the right to cancel your order within 30 days of your purchase by using our CONTACT FORM or e-mail at customercare@innesandiyer.com and we shall give you instructions on how to proceed depending on where you are in your purchasing process. If the payment process has been initiated, your full reimbursement may be delayed due to your bank’s or credit card company’s routines.

Retention of title

All products remain the property of us until full payment is made.

"Pre-orders"

For our products sold under Pre-Order conditions you will have to make a partial (non-refundable) payment (35 %) at the time of your purchase with the remaining part (65 %) to be paid when we notify you of delivery of the product. You will receive notifications by e-mail when you make the partial payment as well as for the final payment. The latter e-mail will also include a Shipping confirmation with shipment tracking information.

Backorders

Certain items may be available to be ordered via ‘Backorder’. This means that when an item is out of stock (and later will be coming back into stock) you can buy and reserve it in advance. Your order will then be dealt with as a priority once the item is back in stock and you will be notified via e-mail.

Sales

We do not accept returns of Sales products for exchanges or refunds other than when our 2-year International Guarantee is applicable.

Promotional codes and gift certificates

Promotional codes and gift certificates should be entered during the check-out process (and not after) to be valid. You should inform us immediately by using our CONTACT FORM or at customercare@innesandiyer.com if you have missed this, and we shall assist you.

Payment methods

You can currently use the payment methods shown in our web-shop (for example PayPal or Klarna and the major international credit or debit cards).

You will need to open an account with PayPal to be able to use that payment method unless you pay through PayPal by using a credit or debit card. We are not affiliated with PayPal Credit, or Klarna Credit so applying for or using any of their credit schemes is entirely at your own discretion and risk.

Card charges will appear on your statement as “INNES & IYER”. No additional cost for your card payments are charged by us. All payments methods have starting conditions applied as soon as the transaction is approved.

Clearance time for your payments could be 3 - 5 banking days depending on your payment provider's routines. If your card issuer refuses to clear your payment, we will not accept your order and we shall not be held liable for any inconvenience to you due to this.

Prices

All prices are registered by us in Euro (€) but our web-shop has been set to show prices in your local currency. In any case, if a Euro amount has been charged it will automatically be changed to your local currency by your card holder or bank and will appear in that currency on your bank statement. Adjustment of prices and offers, including additional costs, are subject to change at our sole discretion and can be done without prior notice at any time with immediate effect.

VAT, local taxes and import duties

We are a Limited Company registered in the Kingdom of Sweden. Our Company Registration Number is 559175-1341 and our VAT registration no. is: SE559175134101.

All prices are when registered on our website inclusive of Swedish VAT in accordance with the applicable legislation. The website is set to show prices in a customer’s local currency inclusive of Swedish VAT.

European Union - Our prices include Swedish VAT (“moms”) so if your purchase is made from a country within the European Union ("EU") no additional VAT or the like should be charged by that country.

Outside the European Union - CURRENTLY WE DO NOT SHIP OUTSIDE THE EU - All orders shipped to an address in a country outside the European Union ("EU") excludes Swedish VAT. The VAT part (currently 20%) of our sales prices is deducted by us for orders outside the EU and removed at the check-out or earlier.

It is the responsibility of you as the customer to be aware of your local tax regulations. This includes any import duty, customs fees, and VAT. We ship DDU (Delivered Duty Unpaid) so the customer is responsible for the payment of any such taxes and duties. We are unable to predict any costs of such taxes or duties, as they are applied by your local customs office and differ from country to country. We advise you to contact your local customs office for more information.

Note for customers outside the European Union; CURRENTLY WE DO NOT SHIP OUTSIDE THE EU - If you decide to use any of your 30-days limit free return, exchange or cancellation options we will apply a cap on costs duly paid by you according to Incoterms 2010 DDU rules (e g local VAT, other local taxes, duties, import formalities costs and customs clearance) to a maximum of 25 % of the purchase price paid by you for the product in our web shop.

DDU

We ship your goods according to Incoterms 2010 “Delivered Duty Unpaid” (DDU) which for example means that we are neither responsible for nor do we pay for import formalities or pay or collect VAT (other than Swedish VAT), duties and/or other taxes.

Therefore, please note that if your delivery address is outside the EU you may be required to pay import duties, VAT and other local taxes that are levied when your shipment reaches your country. These and additional charges for, for example, import formalities and customs clearance are your responsibility and are to be fully paid by you.

Note for customers outside the European Union; CURRENTLY WE DO NOT SHIP OUTSIDE THE EU - If you decide to use any of your 30-days limit free return, exchange or cancellation options we will apply a cap on costs duly paid by you according to Incoterms 2010 DDU rules (e g local VAT, other local taxes, duties, import formalities costs and customs clearance) to a maximum of 25 % of the purchase price paid by you for the product in our web shop.

Credit card information/Secure payments

We never store any credit card information. Through our secure payment system (in which all transactions are encrypted to the highest global standards), which operates under strict banking regulations, your card details are sent directly to your bank and cannot be read or accessed by any other than your bank.

Customer accounts

We do not offer the option of opening a Customer Account for the time being.

INTERNATIONAL GUARANTEE

OUR TERMS DO NOT IN ANY WAY AFFECT A CUSTOMER’S STATUTORY RIGHTS.

INNES & IYER’S INTERNATIONAL GUARANTEE – TWO (2) YEARS

We guarantee the proper function under normal use of our products for a period of 2 (TWO) years from the date of purchase directly from us or from one of our associated retailers. This guarantee applies to manufacturing and materials defects. Components will be repaired or replaced free of charge if proven to be defective in material or workmanship. However, if, for any reason, a particular spare part is no longer produced, Innes & Iyer AB reserves the right, at its sole discretion, to offer an alternative solution.

Note to Customer. Our Guarantee means that if (e g your watch is found to be subject to manufacturing or material defects within 2 years from your date of purchase of your watch and) we can neither repair nor replace your watch or its defective part(-s) with an identical watch or part(-s), an alternative solution can be that we refund you the amount you have paid us for the watch in our web shop.

Authenticity requirements – The Customer must establish that a product is one of our products to be able to call on our Guarantee.  The Customer’s e-mail order confirmation (or a Purchase Receipt from one of our associated retailers) serves as a Proof of Purchase and as the Certificate of Guarantee. It contains the necessary information for a call on the Guarantee. If the Customer has lost the e-mail confirmation it can be provided by us by contacting our service team. If the Customer has lost the Purchase Receipt from one of our associated retailers, the Customer must contact the retailer to obtain a copy of the Purchase Receipt.

Guarantee period variants – The two-year period may vary in some instances for specific products sold by us but in such a case the adjusted period will be clearly displayed on our website and in the order confirmation.

HOW A CALL ON OUR GUARANTEE WORKS

The Customer shall contact us to first, if the call on the Guarantee is found reasonably valid by us, receive our preliminary acceptance (by e-mail) for using the Guarantee. Contact information to be found below.

Free returns – We will, after our preliminary acceptance has been given, arrange for a free of charge pick-up by UPS of the goods when convenient to the Customer. Alternatively, for the return of smaller items such as wristbands, we may send you a pre-paid and addressed envelope.

We strongly advise our customers not to arrange for a return by themselves. Instead they must wait for our e-mail confirmation and shipping instructions as we do not accept taking receipt of a product if it has been sent to us without our prior written confirmation of acceptance.

Repairs - When the product has been returned to us and being found by us to adhere to the terms and conditions of our Guarantee, a repair will be carried out free of charge to the Customer. Alternatively, a replacement product will be sent to the Customer. All parts of the product may be replaced with substitutes if original parts are no longer available. An alternative solution can be that we refund the Customer the amount he/she has paid us for the watch on our web-shop. If the purchase has been done through one of our associated retailers the Customer must contact the retailer for instructions and for information about the retailers repairs and refund policy. 

Extended 2-year period of Guarantee – Under our Guarantee a product repaired by us (or a replacement product issued by us) will hold a new two-year Guarantee from the date the product is received by the Customer.

Refunds - If neither a Guarantee-repair nor a replacement product is possible to provide a refund will be made to the Customer through the payment method used by the Customer when he or she first purchased the product. The refund is limited to the full amount paid by the customer to us at that purchase plus additional costs for local VAT and the like.

No adherence - Should the product be found not to adhere to our Guarantee this Guarantee will be void and we will contact the Customer regarding any further steps to be taken. This may lead to us returning the product to the Customer via the postal system without any repairs having been made by us.

EXEMPTIONS FROM OUR GUARANTEE

This guarantee applies to manufacturing and materials defects under normal use only and consequently does not cover the following:

  • Damages, and/or malfunctioning resulting from mistreatment or improper use or handling (including knocks, blows, dents, crushing and the like), not intended use or accidents.
  • Damages like scratches to watch case, lugs, crown, crystal ("glass"), wristband, strap or buckle or broken glass from mistreatment or improper use.
  • Damages due to fire.
  • Damages due to water when a watch’s ATM classification has been exceeded.
  • Normal wear and tear from normal use and ageing (for example minor scratches, minor peeling of the plating or alterations and fading of the wristbands’ colours);
  • Damages to leather wristbands or straps due to excessive exposure to water (for example by swimming or showering).
  • Allergic reactions.
  • Batteries for quartz watches.
  • Damages, and/or malfunctioning of the watch, caused by (by us) unauthorized persons attempting to repair, or making changes to, the product.
  • Products purchased from a third-party or products that have been personalised, for example monogrammed on the watch case or the dial.
  • Theft, loss or acts of God, accidents or the consequence of natural disasters.
